Terms and conditions
General terms of use and contracting for the quote request service at www.constructores.com
Effective from 21 October 2026
Version: 2026-10-21-v14
Summary of the essentials Before submitting a quote request or using our simulators, read these Terms and Conditions. By ticking the ‘I have read and accept the Terms and Conditions’ box, you enter into a contract with us for a free introduction service. The essentials, in plain language: Constructores.com provides advertising, introductions and commercial follow-up of requests. It handles requests and facilitates communication with up to three companies based on location, specialism and availability. It does not review or assess quotations, choose the company for the client or intervene in carrying out the work. No contract award or response from companies is guaranteed. Constructores.com does not execute, direct, inspect, certify or technically supervise building work. Visits and follow-up by its representatives are commercial; they do not check quality, safety or technical progress and do not replace the appointed technical supervision team. The works contract is entered into directly with the chosen company. Responsibility for performance, delays, defects, damage and warranties rests with those who must bear it under the contract and applicable law. Constructores.com is responsible for its own service as provided by law. Constructores.com does not charge you for this service. Artificial intelligence simulators and price estimates are indicative. They are not a technical project or a quote and do not replace an architect, building surveyor or construction company. Your data are disclosed to the construction companies to which we send your request, which will process them as independent controllers to contact you. This summary is only a reading aid; the binding content is in the following clauses. |

3. Acceptance of the Terms and legal capacity
3.1. Express acceptance
To submit a Request or use Simulators that require data to be provided, the User must read these Terms and the Privacy Policy and expressly accept them by ticking the box provided for that purpose, which is initially unticked. Without this acceptance, it is not possible to submit the Request or use the Service. Acceptance has full contractual validity and effect under Articles 23 et seq. of Law 34/2002 (LSSI) and Law 7/1998 on General Contract Terms.
As evidence of acceptance, Constructores.com will retain the Request data, the date and time of submission and the version of the Terms in force at that time, and will provide the User with an acknowledgement of receipt that can be downloaded and saved from the Platform itself, together with the accepted version of the Terms and Privacy Policy (Article 28 of the LSSI). When email sending is enabled, it may also provide this confirmation by email. The User may save or print these Terms at any time. Each Request is governed by the version of the Terms in force and accepted at the time it was submitted.
3.2. Legal capacity and representation
The User declares that they are over 18 years old and have the legal capacity to enter into contracts. If acting on behalf of a company, an owners' association or another person, they declare that they have sufficient authority or authorisation to do so and to provide the data included in the Request, and are responsible for the truthfulness of this declaration. Minors may not use the Service.
3.3. Documents forming part of the relationship
The following form part of the relationship between the User and Constructores.com, in this order of precedence: (i) these Terms; (ii) the Privacy Policy; (iii) the Cookie Policy; and (iv) the Legal Notice. Constructores.com's relationship with Construction Companies is governed by the contract they sign; that contract does not confer rights on the User against Constructores.com.
4. What Constructores.com is and is not
4.1. Nature of the Service: advertising and introductions
Constructores.com provides advertising, introductions and commercial follow-up of requests. It handles requests and facilitates communication with up to three companies based on location, specialism and availability. It does not review or assess quotations, choose the company for the client or intervene in carrying out the work. No contract award or response from companies is guaranteed.
4.2. What Constructores.com does not do or act as
For the avoidance of doubt, the User acknowledges and accepts that Constructores.com:
- is not a construction, renovation or installation company or a technical practice, and does not provide construction, architecture, engineering, works supervision or project management services;
- Constructores.com does not execute, direct, inspect, certify or technically supervise building work. Visits and follow-up by its representatives are commercial; they do not check quality, safety or technical progress and do not replace the appointed technical supervision team.
- The construction contract is concluded between the client and the chosen company. Constructores.com does not sign or guarantee it and cannot accept quotations or change terms on behalf of either party. Commercial follow-up does not confer technical or representative authority.
- The contractor prepares and takes responsibility for quotations and technical decisions. Constructores.com may receive quotations and invoices for commercial follow-up and commission calculations, without approving measurements, materials, prices, deadlines or technical solutions.
- does not receive, hold, manage or intermediate payments for the works: all payments for the works are made directly by the User to the contracted Construction Company, which issues the invoices. Constructores.com will never ask the User for a payment, deposit, advance payment or bank details;
- does not act as a developer, builder, contractor, subcontractor, designer, works director, execution director, health and safety coordinator, quality control entity, product supplier or any other building participant defined in Law 38/1999 of 5 November on Building Regulation (LOE), nor assume the obligations or liabilities that law assigns to those participants;
- does not hire, select, direct or supply personnel or subcontractors for the works, or supply materials;
- does not provide technical, legal, planning, tax or financial advice; the Platform's content is purely informational and indicative;
- does not recommend, endorse, certify or guarantee any Construction Company, or its solvency, technical capacity, authorisations, insurance, timescales, prices or quality of its work;
- does not mediate or arbitrate disputes arising between the User and the Construction Company.
4.3. Independence of Construction Companies
When registering a construction company, we request the signed contract, the REA certificate where legally required and the civil liability insurance documents specified for the collaboration. We review the documents provided and record their status; the company must keep them current and report any changes. This review does not certify the quality of the work or guarantee coverage for a particular claim.
Contractors are independent businesses. They may not present themselves as Constructores.com staff, partners or franchisees or use its brand on contracts, quotations or invoices without written permission. The description of the relationship does not exclude liability or mandatory rules arising from the activities actually performed.
The contractor must keep its REA registration current where legally required and, in all cases, maintain current public liability insurance, pay the premiums and report any non-payment, suspension or loss of cover. If it is not required to register with the REA, it must justify this through a signed declaration and documents reviewed before activation, and report any changes. Constructores.com’s document review does not constitute continuous monitoring of payments or guarantee that a particular claim is covered. The client may request updated evidence from the company before contracting.
A request sent by mistake does not authorise a company whose collaboration has ended or been suspended, or which fails to meet these requirements, to accept new work. The contractor is responsible for paying for and maintaining its insurance. This does not limit the client’s rights or Constructores.com’s own statutory liabilities.
4.4. Free service for the User and revenue model
The service is free for customers. Constructores.com receives the commissions agreed in its partner companies’ contracts for work started and payments received. This remuneration does not make the platform the executor or guarantor of the works and does not alter liability for its own service. Each company sets its prices independently.
5. How the Service works
5.1. Submitting the Request
The User describes the building or renovation work they wish to undertake in the Platform's form, states its location and provides their contact details and, optionally, photographs, plans or documents. The steps are: (i) complete the form; (ii) review the entered data, which can be corrected before submission; (iii) read and accept these Terms and the Privacy Policy by ticking the corresponding box; and (iv) press the submit button. After submission, the User may download a confirmation with the reference, acceptance date and a copy of the accepted Terms and Privacy Policy. There is no need to create a user account. The procedure is available in Spanish, Catalan, English, French, German and Russian.
5.2. Forwarding to Construction Companies and allocation criteria
Constructores.com will forward each Request to a maximum of three (3) Construction Companies. Our team manages allocation taking into account the location and type of work, the areas and specialities declared by Construction Companies and the availability they have communicated. Forwarding does not imply a technical comparison of the companies or a recommendation of the most suitable company for the User. The User does not pay for this service.
A Construction Company's receipt of the Request does not mean that Constructores.com recommends it, has selected it as the best option for the User, or guarantees its solvency, qualifications or quality of work. Constructores.com does not guarantee that the Request will receive a response, a minimum number of quotes or a response time, since these depend exclusively on Construction Companies and their availability in each area. If there are no Construction Companies available for the area or type of work, the User may enquire about the status of their Request at hola@constructores.com.
5.3. Direct contact and freedom of choice
Construction Companies may contact the User by telephone, email or messaging, subject to availability. There is no guarantee that they will respond, provide a quotation or do so within a specific period. Site visits, technical decisions, quotations and agreements for carrying out the work are handled directly between the User and the Construction Company. The User may request other offers within or outside the Platform and freely decide whether to engage a company; neither party is required to submit or accept a quotation. Constructores.com may carry out commercial follow-up to check whether contact has been made, quotations have been delivered and the work has been awarded, without directing or supervising the work.
5.4. Quotes, contracting and payments
Quotations, contracts, invoices, payments, deadlines, warranties and changes to the work are agreed directly between the User and the Construction Company, which issues its quotations and invoices under its own name and tax identification number. Constructores.com may receive information and documentation for commercial follow-up and verification of its commissions, in accordance with the Privacy Policy; it is not a party to the Construction Contract, does not approve it and does not receive or manage payments for the work. If anyone asks the User for a payment, deposit or bank details “on behalf of Constructores.com”, the User must not comply and must report it immediately to hola@constructores.com.
6. Simulators, calculators and artificial intelligence tools
6.1. Indicative nature
The simulators generate indicative images and estimates using supplied data and the platform’s calculation references. They do not verify the property’s actual condition or constitute verified market prices, technical projects or executable quotations. The customer and company must arrange the necessary technical checks. Constructores.com retains legal responsibility for its own service.
The results of the Simulators do not constitute a technical project, an executable design, a measurement, a valuation, a quote, a contractual offer or professional advice; they do not replace the involvement of an architect, architectural technologist, engineer or other qualified professional required by law or by the complexity of the works; and they do not guarantee that the represented works are technically feasible or compliant with planning or other legal requirements, or that they can be performed at the estimated price. The only valid price is that stated in any quote provided by the Construction Company.
6.2. Content provided by the User
The User warrants that they have the right to use the photographs, plans and documents they provide to the Simulators or the Request, that these do not infringe third-party rights and that, as far as possible, they do not contain images of identifiable individuals or special-category data. The User grants Constructores.com a free, non-exclusive and limited licence to store, process and transform that content solely to generate the requested results, forward the Request to Construction Companies and provide the Service, under the terms of the Privacy Policy. Constructores.com will not use the User's photographs for advertising purposes without their express consent.
6.3. Use of the results
The User may use the images and estimates as inspiration and to explain their request to companies. The limitations and necessary checks are described in section 6.1.
7. User obligations
The User undertakes to:
- provide truthful, accurate, complete and up-to-date information in the Request, and keep it updated while the Request is ongoing;
- submit Requests only for real needs of their own (or those of the person or entity they legitimately represent), and not use the Service for testing, comparing prices without any intention to contract, collecting data from Construction Companies, competition or any other purpose unrelated to obtaining quotes for actual works;
- not provide third-party personal data without their authorisation and without informing them of the provisions of the Privacy Policy, or impersonate another person;
- use the Platform in accordance with the law, these Terms, the Legal Notice and good faith, refraining from conduct prohibited in the Legal Notice;
- treat Construction Companies courteously and clearly inform them if they do not wish to continue contact;
- fulfil, in relation to the works they contract, their obligations as owner and, where applicable, developer under the LOE and planning legislation, including obtaining the necessary municipal permits, authorisations or submitting notifications, commissioning the technical project where mandatory, obtaining authorisations from the owners' association, and complying with applicable health and safety regulations;
- be liable to Constructores.com and third parties for any loss or damage caused by breaching these obligations.
Constructores.com may refuse to process Requests that are incomplete, manifestly false, abusive or fraudulent, and may suspend or prevent use of the Platform by anyone who breaches these Terms, informing the User of the reasons where possible.
8. Relationship between the User and the Construction Company. Construction Contract
8.1. Independent contract
Any Construction Contract entered into by the User with a Construction Company is an independent contract, concluded outside the Platform, to which Constructores.com is not a party and in which it is not involved. It is governed by the agreement between the User and the Construction Company and by applicable legislation, in particular the Civil Code, Law 38/1999 on Building Regulation (in relation to works within its scope and the guarantee and liability periods for building participants), legislation on subcontracting in the construction sector and, where the User is a consumer, the TRLGDCU and regional consumer protection legislation. The appointed Building Company is responsible for its commitments and its obligations under the contract and the law. The responsibilities of the Building Company, the owner and other parties involved in the work will be determined by their conduct and applicable law, without excluding Constructores.com’s own responsibilities for its service.
8.2. Issues with a Construction Company
The Construction Company will handle complaints concerning its quotations, contract and performance of the work and will fulfil the obligations for which it is responsible under the law. The User retains their rights of action against any person who is legally responsible. Constructores.com will handle complaints concerning its own service and forward complaints it receives about the work to the Construction Company. Receiving or forwarding a complaint does not mean undertaking repairs, providing guarantees or arbitrating the dispute. You can contact us at hola@constructores.com.
8.3. General information before contracting
As general information, without assessing particular companies or quotations, the User may consider the following checks before contracting:
- ask each Construction Company for a detailed written quote broken down by item (work, materials, quality levels, price including taxes, start and completion dates, payment method, guarantees and exclusions), and compare several offers;
- sign a written contract with the Construction Company setting out the agreed terms, and retain quotes, contracts, invoices, payment receipts and communications;
- link payments to the actual progress of the works, avoid disproportionate advance payments and require an invoice for each payment;
- engage a qualified professional (architect, architectural technologist or engineer) for the design and supervision of the works where legally required or advisable due to their complexity, and verify that the necessary municipal permits or notifications and authorisations from the owners' association are obtained before starting;
- in the case of owners' associations, ensure that contracting is approved in accordance with the Horizontal Property Law and the association's bylaws.
9. Liability of Constructores.com
9.1. Liability for its own Service
Constructores.com is responsible for its advertising, diligent handling and commercial follow-up of requests, and its processing of data. The contractor is responsible for its quotations, work, personnel, subcontractors and guarantees as required by law. No clause excludes Constructores.com’s own liability or the client’s non-waivable rights.
9.2. No liability for the construction work or the actions of Construction Companies
Introductions and commercial follow-up alone do not make Constructores.com the contractor or guarantor of the works. The following obligations belong to the appointed company or those legally responsible, without excluding Constructores.com’s liability for its own acts or omissions:
- the accuracy, truthfulness, lawfulness or fulfilment of information, offers, quotes, promises or statements made by Construction Companies to the User, or the identity or status of those who contact them;
- the conclusion, validity, content, performance, breach, rescission or termination of the Construction Contract, including delays, abandonment of the works, cost overruns, changes and disagreements over price;
- the execution, quality, suitability, safety, legality or outcome of the works; building faults or defects, whether apparent or hidden; material damage or personal injury caused during or after the works to the User, their property, neighbours or third parties; and the statutory or contractual guarantees relating to the works;
- the actions, solvency, insolvency, cessation of activity, lack of authorisations, permits, insurance or sufficient coverage of Construction Companies, their personnel, subcontractors or suppliers, or their compliance with employment, tax, Social Security, occupational risk prevention, planning or consumer protection regulations;
- payments made by the User to the Construction Company or third parties, or advance payments that are not refunded;
- the processing of the User's data by Construction Companies once disclosed, for which each Construction Company is responsible as an independent controller;
- decisions the User takes based on the Platform's informational content or the results of the Simulators.
A free service does not remove Constructores.com’s obligations. Defining roles does not prevent claims for its own acts or omissions or limit each participant’s statutory liability.
9.3. Availability and technical matters
Constructores.com does not guarantee uninterrupted operation of the Platform. If an incident occurs, it will apply reasonable security measures and act diligently to restore the Service. Interruptions, errors, cyberattacks or third-party involvement do not, by themselves, exclude its liability. Constructores.com will be liable where the incident is attributable to it or where the law so provides. The User retains the right to make a claim and to cancel the Request free of charge.
9.4. Preservation of rights
Nothing in these Terms excludes or limits Constructores.com's liability for wilful misconduct or gross negligence, harm to life or physical integrity caused by its own acts or omissions, or any other circumstances in which the law does not permit liability to be excluded or limited; nor does it limit or exclude the non-waivable rights recognised by consumer and user protection legislation. If any clause is declared void, it shall be treated as if it had not been included, and the remaining Terms shall remain effective.
10. User reviews, ratings and content
If the Platform allows reviews, ratings, photographs or other content about Construction Companies to be published, the User warrants that they reflect their real and truthful experience, that they have the right to publish them and that they do not infringe third-party rights, and grants Constructores.com a free, non-exclusive, worldwide licence to display them on the Platform and its channels for as long as they remain published. Content that is false, offensive, defamatory, discriminatory, unlawful, promotional, includes third-party personal data or infringes third-party rights is not permitted.
If reviews of Construction Companies are enabled, only Users whose Request has been forwarded to the company and who have actually purchased or used its services in the thirty calendar days preceding the review date may publish them. Forwarding a Request does not, by itself, establish such purchase or use. Clear information will appear alongside the reviews explaining whether and how this is verified and how reviews are processed.
The Construction Company may reply to a review through the same channel and request its removal at hola@constructores.com if it does not come from a consumer who has actually purchased or used the service or is misleading, providing reliable evidence supporting the grounds stated. Constructores.com will examine the evidence and communicate a reasoned decision to the parties concerned. A negative review will not be removed solely because it is unfavourable.
Constructores.com does not publish fake reviews or commission third parties to write them, and does not alter the meaning of published reviews. It may refuse to publish or remove content that breaches this clause or the Legal Notice, informing the User of the reasons. Reviews express the subjective experience of their author and do not constitute a recommendation or guarantee by Constructores.com.
The procedure for reporting allegedly unlawful content and the moderation rules are described in the Legal Notice.
11. Intellectual and industrial property
The Platform, its design, code, text, databases, trademarks, logos, Simulators and other content belong to Constructores.com or its licensors and are protected by intellectual and industrial property legislation. The User may use them only for the purposes of the Service and in accordance with the Legal Notice. User-provided content and images generated by the Simulators are governed by clause 6 and the Privacy Policy.
12. Personal data protection
Constructores.com processes the User's personal data as controller in accordance with the GDPR, the LOPDGDD and the Privacy Policy, which the User declares they have read. In particular, the User is informed that the data in their Request (identification, contact details, location and description of the works, photographs and documents) are disclosed to the Construction Companies to which the Request is forwarded, which will process them as independent controllers to contact the User and prepare their quote, and must inform the User about their own processing. Constructores.com may also contact the User to find out whether they have contracted with a Construction Company and their level of satisfaction, and receive information about contracting from Construction Companies to manage the advertising services associated with the request and their invoicing, on the basis of its legitimate interest, to which the User may object at any time. Rights of access, rectification, erasure, objection, restriction and portability may be exercised at hola@constructores.com.
13. Communications
Constructores.com provides a downloadable confirmation of the Request and the accepted texts on the Platform. To manage the Request, respond to enquiries and carry out follow-up, it may use email, telephone and, where applicable, SMS or messaging. It will only send commercial communications about its own services if the User has authorised this by ticking the specific box, independently of accepting these Terms, and the User may revoke that authorisation at any time, free of charge, via the link included in each communication or by writing to hola@constructores.com.
14. Cancelling the request and the User’s rights
The Service is free. Submitting the form registers the Request for processing and does not mean it has already been forwarded to Construction Companies or that the Service has been fully performed. The User may cancel the Request or ask for it not to be forwarded to any further Construction Companies at any time, without cost or needing to give a reason, by writing to hola@constructores.com. If the Request has not yet been disclosed, its forwarding will be stopped; if a Construction Company has already received it, the User may ask that company directly to cease contact, without prejudice to Constructores.com handling the cancellation in relation to its own Service and its data protection obligations. Acceptance of these Terms does not constitute an advance waiver of the right of withdrawal or of any other applicable non-waivable rights.
15. Duration, suspension and termination
The relationship between the User and Constructores.com begins with acceptance of these Terms and continues while the Request is ongoing and during the subsequent follow-up described in the Privacy Policy. The User may terminate it at any time in accordance with clause 14. Constructores.com may suspend or terminate the Service for a User in the event of a breach of these Terms, fraudulent or abusive use, or a requirement from an authority, informing them of the reasons where required by law. Termination does not affect Construction Contracts the User has entered into with Construction Companies or rights and obligations arising beforehand.
16. Changes to the Terms
Constructores.com may publish new versions of these Terms for future Requests, stating their version number and date and explaining material changes before acceptance. Each Request will be governed by the version accepted when it was submitted. No update will retroactively impose costs, additional obligations or reduced rights. Changes to an ongoing Request will require the express agreement of the parties, except for changes required by law, of which the User will be informed. The User may cancel the Request free of charge under clause 14.
17. User support, complaints and dispute resolution
The User may send any enquiry, complaint or claim concerning the Constructores.com Service to hola@constructores.com, call (+34) 941 680 998 or write to C/ Lepant, 270, 08013 Barcelona, stating their name, contact details, Request reference and grounds. They may also use the channel through which the contractual relationship began. Constructores.com will provide direct personal assistance, acknowledge receipt and supply an identification reference and written acknowledgement on paper or another durable medium, such as email. It will respond as soon as possible and, in any event, within a maximum of fifteen days of the complaint being submitted (Article 21 of the TRLGDCU). Complaints and claims concerning the works must be addressed to the Construction Company in accordance with clause 8.2.
Constructores.com has official complaint, claim and reporting forms issued by the Generalitat de Catalunya, which are provided electronically upon request to hola@constructores.com, under the terms of the Legal Notice. Consumer Users may also contact their municipality's Municipal Consumer Information Office, the Agència Catalana del Consum or the consumer authority in their autonomous community, and Consumer Arbitration Boards. Constructores.com is not a member of the Consumer Arbitration System or any alternative dispute resolution entity for consumer matters, without prejudice to its ability to accept their involvement in individual cases.
For the purposes of Organic Law 1/2025 of 2 January on measures concerning the efficiency of the Public Justice Service, a prior complaint by a consumer User addressed to Constructores.com's customer support service at the addresses indicated shall be considered a negotiation activity prior to court proceedings.
18. General provisions
If any clause of these Terms is declared invalid or unenforceable, it will be treated as unwritten and the remainder of the contract will remain in effect where legally possible. Failure to exercise a right does not constitute a waiver by either party. Any voluntary transfer of either party’s contractual position will require the other party’s consent, except in cases of succession or transfer provided for by law. The transfer will not reduce the User’s safeguards or extinguish liabilities that have already arisen. Constructores.com will communicate the new provider’s identity and contact details where applicable, and the User will retain the option to cancel the Request free of charge.
19. Governing law and jurisdiction
Spanish law applies without depriving consumers of their applicable mandatory protection. Jurisdiction lies with the courts determined by applicable procedural law, including the courts of the consumer’s domicile where appropriate. These standard terms impose no exclusive territorial jurisdiction on consumers or businesses.
20. Language and copy of the Terms
These Terms are available in Spanish, Catalan, English, French, German and Russian. The User can download and save the confirmation of their request together with the accepted Terms and Privacy Policy. They can request a copy at hola@constructores.com. Constructores.com archives the electronic document formalising the acceptance, which will be accessible to the User upon request.
