Automated decisions: your request may be allocated to Construction Companies using automatic rules based on geographical area, type of work and the availability declared by Construction Companies. This allocation does not have legal effects on you or significantly affect you, since you freely decide whether to contact or contract with a Construction Company. The simulators generate automated results that are purely indicative. We do not make decisions based solely on automated processing that have legal effects on you or similarly affect you, nor do we carry out profiling for that purpose.
5. Recipients of the data
5.1. Construction Companies: independent controllers
To provide the service, we disclose the data in your request (identification, contact details, location, description of the works, photographs and documents) to the Construction Companies to which we forward it, with a maximum of three per request. This disclosure is necessary to perform the service you request (Art. 6.1.b GDPR). Each Construction Company will process your data as an independent controller, under its own responsibility, to contact you, prepare its quote and, where applicable, manage the construction contract, and must inform you of its own processing no later than in its first communication with you (Article 14 of the GDPR).
Each contractor will use the data to handle the request and, where applicable, perform the order. Access by its staff, suppliers or subcontractors and any further disclosure require a valid legal basis and applicable safeguards. Data may not be used for unrelated advertising without an independent legal basis and appropriate information. Each party is responsible for its own processing.
5.2. Data processors
Providers of the following services may access your data on behalf of Constructores.com under a data processing agreement in accordance with Article 28 of the GDPR: website and data hosting; email and sending communications; customer and form management; telephone and messaging; generation of images and estimates using artificial intelligence; website security and performance (Cloudflare); and technical support. These providers only process data according to our instructions and may not use them for their own purposes. The photographs and data you enter in the simulators are used exclusively to generate the results you request and provide the service; Constructores.com does not use them to train artificial intelligence systems.
If you accept Statistics, we use Google Analytics to measure visits and use of forms and generators. Google receives browsing data and cookie identifiers. We do not activate Google Signals or personalized advertising. See the Cookie Policy for cookies, their lifetimes and international transfers. You can withdraw consent using Manage consent.
External commercial agents (commercial representatives) acting on behalf of Constructores.com under a data processing agreement may also access files. Their access is limited to the information needed for the functions and requests entrusted to them, subject to confidentiality, documented instructions and security measures. They may not use the data for their own purposes or offer guarantees about the works.
The simulators’ artificial intelligence provider is OpenAI. Image generation requests, including photographs you provide for editing, are sent to its API and may be processed in the United States. Do not send sensitive data or images of identifiable people. International transfers are described in section 6.
5.3. Other recipients
Your data may also be disclosed: to public authorities, courts, law enforcement bodies and consumer authorities where there is a legal obligation or requirement; to our legal advisers, auditors and insurers where necessary to manage claims or defend our rights; and to any company that succeeds Constructores.com as owner of the Platform. Constructores.com does not sell or rent your personal data.
6. International transfers
Some of our providers (for example, Cloudflare or the provider of the simulators' artificial intelligence system) may be located or process data outside the European Economic Area, particularly in the United States. In these cases, the transfer takes place with the safeguards provided for in Chapter V of the GDPR: an adequacy decision by the European Commission (such as the EU–US Data Privacy Framework for certified entities) or standard contractual clauses approved by the European Commission, with any appropriate supplementary measures. You can request information about the safeguards applied at hola@constructores.com.
7. Your rights
You may exercise the following rights at any time:
- Access: find out what data we process about you and obtain a copy.
- Rectification: correct inaccurate data or complete incomplete data.
- Erasure: ask us to delete your data when they are no longer necessary, you withdraw your consent or object to processing, among other circumstances.
- Objection: object to processing based on our legitimate interest (follow-up, management of advertising services, security) on grounds relating to your particular situation, and in all cases to the sending of commercial communications.
- Restriction: ask us to restrict processing in the circumstances provided for in Article 18 of the GDPR.
- Portability: receive the data you have provided to us in a structured, commonly used and machine-readable format, or have them transmitted to another controller.
- Withdraw consent at any time, without affecting the lawfulness of earlier processing.
- Not to be subject to decisions based solely on automated processing which have legal effects on you or significantly affect you.
To exercise them, write to hola@constructores.com (subject: ‘Data protection’) or to C/ Lepant, 270, 08013 Barcelona, stating the right you wish to exercise and the details needed to identify you and locate your request (name, email address and telephone number used). If there are reasonable doubts about your identity, we may ask you for additional information to verify it. We will respond within a maximum of one month from receipt of the request, which may be extended by two further months in complex cases, informing you of this. Exercising your rights is free of charge.
If you consider that we have not properly upheld your rights or that the processing breaches the legislation, you may lodge a complaint with the Spanish Data Protection Agency (www.aepd.es; Edificio Cuzco IV, Paseo de la Castellana, 141, planta 9, 28046 Madrid; electronic office sedeagpd.gob.es). We would appreciate the opportunity to deal with your complaint at hola@constructores.com before you do so.
To exercise your rights against a Construction Company in relation to its processing of your data, you must contact that Construction Company directly, as it is an independent controller of its processing.
8. Commercial communications
We will only send you Constructores.com's commercial communications by email or other electronic means if you have authorised this by ticking the specific box, which is independent of acceptance of the Terms and Conditions and is not a condition of receiving the service. You may unsubscribe at any time, free of charge, using the link included in each communication or by writing to hola@constructores.com. Communications necessary to manage your request (acknowledgement of receipt, request status, follow-up surveys) are not commercial in nature.
Construction Companies to which we forward your request will contact you by telephone, email or messaging to deal with your request; they make these communications in their own name and in response to your quote request. If you do not wish a Construction Company to continue contacting you, tell it directly and, if you wish, inform us at hola@constructores.com.
9. Minors
The Platform is intended exclusively for individuals over 18 years of age. We do not knowingly collect data from minors. If we become aware that we have received a minor's data without authorisation from their legal representatives, we will erase it. If you are the parent or guardian of a minor who has provided us with data, please write to hola@constructores.com.
10. Data security
Constructores.com applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk, in accordance with Article 32 of the GDPR, including encrypted communications (HTTPS), access controls, limiting the personnel with access to the data, backups, confidentiality and data processing agreements with providers, and procedures to manage security breaches and, where appropriate, notify the supervisory authority and affected individuals. Nevertheless, no transmission over the internet is completely secure, so we recommend that you do not include more information than necessary in your requests.
11. Social media
Constructores.com may have profiles on social media such as Facebook, Instagram, LinkedIn or YouTube. If you interact with them, we process the data you make public or send us through the social network to manage the community and respond to your messages, on the basis of our legitimate interest or your consent. Each social network is responsible for its own processing under its policies, and in relation to page statistics Constructores.com and the social network may be joint controllers under the terms set by the social network.
We do not share data from public profiles or social interactions with Construction Companies merely because it is available on a social network. If you deliberately send us a request for a quotation through a private message or a form on a social network, before forwarding it we will provide you with the service and data protection information and record your request and acceptance of the applicable texts. Only the data necessary to handle that request will be shared with a maximum of three companies, on the same legal basis and with the safeguards stated in this Policy. An interaction on a social network does not in itself constitute a request for quotations or consent to advertising.
12. Links to third-party websites
The Platform may include links to third-party websites (public registers, public authorities, Construction Companies, social media), which have their own privacy policies. Constructores.com is not responsible for the processing carried out by those third parties.
13. Changes to this Privacy Policy
Constructores.com may amend this Policy to adapt it to changes in legislation, technology or the service. The current version, including its date, will always be published on the Platform. If changes substantially affect the processing of data of users with ongoing requests, we will notify them by email.
Applications for sales collaboration
If you apply to collaborate as a sales representative, we use your contact details, stated areas, experience and CV to assess your application and contact you at your request. The legal basis is taking pre-contractual steps at your request (Article 6(1)(b) GDPR); for company representatives’ contact details, it is the legitimate interest in maintaining that professional relationship (Article 6(1)(f) GDPR and Article 19 LOPDGDD). The application is stored privately for the authorised team and sent to hola@constructores.com; it is not published online and does not create a CRM account. The retention criterion is the duration of the assessment process and discussions about that collaboration; once they end, only information needed to address liabilities may be retained with access restricted for the applicable statutory periods. We will not use the CV for future applications outside that process without a specific legal basis and information. Do not send sensitive information or identity documents. The rights and contact channels in section 7 also apply to your application.
Original photos and design proposals
If you provide a photograph to create a design, we store the original photo and proposal privately. When you submit a quotation request with that design, both images are linked to your record and can be viewed by the authorised team and construction companies assigned to the project. They are not published on the website. Designs without a request become inaccessible after 30 days and are deleted during subsequent maintenance operations, which run when the Platform receives activity. Those linked to a request follow its retention period. You can request access or deletion by writing to hola@constructores.com.
